Here are some of the most frequently asked questions on the changes to the Homebuyer Tax Credit.

Questioon: Existing homeowner credit: Must the new house cost more than the old house?
Answer: No. Thus, for example, individuals who move from a high cost area to a lower cost area who meet all eligibility requirements will qualify for the $6500 credit.
Question: I am an existing homeowner. On October 25, 2009, I signed a contract to purchase a new home. I have lived in my current home for more than 5 consecutive years and am within the new income limits. I will go to settlement on November 20. If President Obama has signed the bill by the time I go to settlement, will I qualify for the new $6500 tax credit?
Answer: Yes. The existing homeowner credit goes into effect for purchases after the date of enactment (when the bill is signed). There is no reference to the date of contract for the new credit. The provision looks solely to the date of purchase, which is generally the date of settlement.
Question: I am a firsttime homebuyer but was not within the prior income limits at the time I entered into my contract to purchase on October 30, 2009. I will be covered, however, by the new income limits. If the new rules have been signed into law by the time I go to settlement will I be eligible for a credit?
Answer: Yes. The new income limitations go into effect as soon as the President has signed the bill. The income limit and other eligibility rules will look to your status as of the date of purchase, which is the settlement date. So if the new rules have been signed when you go to settlement, you should be eligible for the credit (or a portion of the credit if you're within the phaseout range).
Question : I am an eligible existing homeowner. I have a fair amount of equity in my home. I have found a home with a nonnegotiable price of $825,000. Will I be able to use any of the $6500 tax credit?
Answer. No. the $800,000 cap on the cost of the purchased home is firm at $800,000. Any amount above $800,000 makes the home ineligible for any portion of the credit. The $800,000 is an absolute ceiling.
Question: I owned my home for 10 years, but sold it two years ago and have been renting since. If I purchase a home, will I be eligible for the $6500 Tax credit if I meet all the other eligiblity tests?
Answer: Yes. Because you lived in the home for more than 5 consecutive years of the previous 8, you will qualify for the $6500 credit. For example, Say John and his wife bought a home in 2000 and lived there until 2008 when he got a divorce. Whether John has been renting or bought in the interim, he WOULD INDEED be eligible for the credit because he owned a home and occupied it as his principal residence for 5 consecutive years out of the last 8 years. The keyword here is "consecutive." As long as he lived in that house for 5 years straight what he did since 3 years doesn't impact eligibility.
Question: I am an eligible first time homebuyer, I entered into a contract to purchse on November 1, 2009. Do I have to go to closing before December 1? How does the extension date affect me?
Answer: You do not have to close before December 1. Once the legislation has been signed , it will be as if the Nov 30 date had never existed. Therefore, so long as the contract settles before April 30 (or July 1, worst case), the purchaser will be eligible for the credit.

Extended & Expanded Home Buyers Tax Credit!

Homes have to be purchased between November 6, 2009 and June 30, 2010 (ratified contract by April 30).

Existing home owners are now eligible if they have owned a principal residence for 5 consecutive years out of the 8 years preceding the purchase of a new home.

Ownership of vacation property or rental property does not disqualify home buyers from this program.

1.) The full $8,000 Tax Credit is for first-time-home buyers who have NOT owned a principle residence during the three-year period prior to the purchase.

2.) The maximum credit is $8,000 or 10% of the home purchase, whichever is less.

3.) The credit is available for homes purchased on or after November 6, 2009 and before June 30, 2010. However contracts must be fully ratified by April 30, 2010.

4.) Modified Adjusted Gross Income, to qualify for full tax credit please contact your tax advisor.

5.) There is no Recapture or Repayment Clause if the home is owned for at least 36 months.

6.) Current homeowners who have owned and used the same residence as a pricipal residence for any 5-consecutive year period may be eligible for a $6,500 tax credit.

7.) The full amount of the eligible tax credit is refunded to the buyer, even if it is more than what you have paid in, in taxes.

8.) Home purchase cap $800,000 (no cap in previous version)

9.) Special exemptions and extensions for military... please contact your Tax Advisor.

10.) Credit is only available to purchasers who are at least 18 years old.

11.) This version now requires that the home purchaser attach a properly executed copy of the settlement statement used to complete the purchase to the tax return.

NOTE: Please consult your tax advisor/accountant to determine whether you are eligible for this tax credit. This information should be verified by your tax professional.

It's County Fair Time in Mountain Home Arkansas!

Since next week is the Baxter County Fair in Mountain Home, Arkansas I started thinking about what the County Fair means to me:

Blocking off main street to watch the Fair Parade.
Remembering as a child when mama and daddy would get us kids dressed up to go have a good time.
Remembering going to the fair with my teenage friends without mama and daddy.
Reminder that fair time is usually the first time, since last winter for a light jacket as temperatures are now cooling down.
Usually get to see a lot of people that I haven't seen in a long time.
Seeing all the just bathed animals, with their shiny, groomed coats of fur.
Enjoying all the proud little, round, rosy cheeked, country kids so proud of their pet cow, pig, goat etc. (My little brother used to be one of them).
Remembrance of my mother volunteering to cook hamburgers and hot dogs at the Buford 4-H food booth (those were the BEST hamburgers and hot dogs... I can still see her there when I close my eyes).
Seeing all the winning ribbons that some will prize for a lifetime.
The midway... filled with laughter, screams and smells of cotton candy and funnel cakes.
The mystique of the Carnies' & their Gypsy lifestyles.
A place to go where everyone is smiling.

Summer is not over yet Folks!

Today while out showing homes, previewing homes and doing a lot of driving around I was thinking about what beautiful weather we have had this year, and are we even going to have any “Dog Days” of August!

Summer especially has been the perfect summer, not too many hot days, and not too many humid days just perfect really! While driving around the beautiful Twin Lakes area what I am seeing are not as many boats on the highway, and am seeing the hustle and bustle of “back to school” shopping which makes me think now that it’s getting to the near end of summer but “Summer is not over yet folks!”

The Twin Lakes area always has a lot of “goings on” and particularly right now the lake waters are perfect for water sports and fishing. The three rivers are great for fishing, canoeing, floating and swimming!

Lots of sight-seeing areas, shopping at the local boutiques, antique shops or any of the many other stores. Fine or casual dining is your choice at many of our local restaurants… want a lake view, river view or mountain view with that?

I could go on and on about the beauty and things to do in this area but one needs to see it firsthand. If you would like any additional information just let me know and I will be happy to share part of my world with you and maybe even a house or two!

ARKANSAS ROCKS!

Today I want to talk about rocks!

My inspiration comes from being at the river cabin this past weekend moving some of my rock collection! The rock collection I am talking about are the rocks that I have collected over the years and have moved them around the country with me when relocating! This time I was moving them from one flower bed to another. My rock collection ranges from really large to small and they all have a story to be told!

Being a fifth generation native to the Ozarks I have stumped my toe and have had several stone bruises on my heels running around barefooted as a child! Today I am a bit more tender-footed so my toes are being treated better and the stone bruises have come to a halt!

I suppose I have always enjoyed finding pretty and unusual rocks! As a child that was one of my favorite things to do when making my play houses, walking in the woods, swimming in the Buffalo River and White River, swimming in Lake Norfork and Lake Bull Shoals, splashing in the area creeks and just being a kid skipping and throwing rocks! Today I am still playing with rocks… and today I still look for rocks.

Arkansas is a state of many rocks and minerals from my humble rock collection, to quartz and real diamonds! You can find a rock shop in just about any town in the state of Arkansas, the rock shops consist of a small road side vendor with a free hand sign to a full blown rock gallery! There are some towns you can go to and specifically dig for diamonds and beautiful crystals! This is just another adventure of Arkansas, The Natural State! Hurry and don’t miss your adventure in the beautiful Ozarks!

Waterfall Rock, This rock belonged to my Mother n' Law. She kept this rock in her flower bed and I have always admired this rock, in fact I admired it for 20 years! It has a new home now and comes with many good memories of a special lady!

(Petrified) Egg Rock, Randall found this rock approx 50 years ago! He was 8 years old and was at his bus stop waiting for the bus. This rock caught his eye and he picked it up and started tossing it up in the air and catching it... one time he missed his catch and the rock landed on a larger rock and split open and this was what was inside! He remembers being so excited!

Rabbit Rock, I found this rock in a creek bed one morning while I was out looking for Morel Mushrooms. I was crossing the creek which flows into the White River and the rock caught my eye, loaded it onto the 4-wheeler and away I went!

River Rock, this rock just showed up at the river cabin one day! I came home and there was this neat rock that looked like a river running through, and no note attached! Many friends and family know that I have collected neat, sentimental and unusual rocks for many years and those same people know that they can visit the river cabin regardless if we're at home or not. They are welcome to sit in the adirondiak chairs along the river's edge, relax, fish in one of the best fishing spots on the White Rive or just hang out soooo I thiking one of them left it for the rock collection! To this day though I still don't know who left it but it was a nice gift!

A Perfect Summer Day in the Ozarks!

I couldn't believe it when I stepped outside this morning! ABSOLUTELY beautiful day in the Ozarks!

Now... we have to remember that this is the middle of July and typically it is one of the hottest months for Mountain Home, AR and the surrounding areas however today the tempertature is 86 degrees with no humidity, the wind is blowing the sun feels good on your back and at one point it felt like a fall day to me!

I am looking forward to showing my clients homes on Lake Bull Shoals tomorrow because it is going to be a beautiful weekend, forcast of 82 for the high! Now that's another perfect summer day in the Ozarks!

Ahhh the fresh air, clean water, and the natural beauty of Baxter County!
Baxter County is located in the north central section of Arkansas and is approximately 600 square miles with elevations ranging from 800 to 1,400 feet. Baxter County was formed on March 24, 1873. Our northern border is at the state of Missouri, up in the Ozark Mountains!
We are known for our two lakes and three rivers which provide great fishing and other water sports, camping canoeing, floating, hiking trails, bike trails etc. and all include the beautiful back drop of the Ozark Mountains! It just doesn’t get much better!
The county has two hydroelectric dams operated by the Corps of Engineers. Norfork Dam is located on the North Fork River and Bull Shoals Dam is located on the White River at the river mile 418.6 in Baxter and Marion counties, seven miles north of Cotter and 10 miles west of Mountain Home.
There are numerous items that make Baxter County a desire to live, raise a family, vacation or relocate and I will be expanding on those in later post so be sure to come back and check my blog postings.

Sharing the Ozarks!

What a beautiful spring we have had this year! With the rainfall we have had the foliage is making a colorful statement with its growth and many shades of green! We are now starting into our summer months here and it’s so nice to live in a “true” four season climate!

I had a chance to catch a few chapters of reading this evening and I wondered what the first settlers of Baxter County were doing back in 1541…

The book is: History of Baxter County by Mary Ann Messick and I would like to share a couple of paragraphs with you:

“As far as recorded history is concerned the first Europeans to travel across the Territory of Baxter County were a band of the Grande Conquistadores from Hernando DeSoto’s party. They had entered Arkansas May 21, 1541, and several months later, splinter groups began to traverse the area.”

“The first permanent settlers in Baxter County, according to all the experts were the Cliff Dwellers, or the Rock Shelter People.” According to the author of this book, “it would have to be a choice between them and the mysterious Mound Builders. Who were the Mound Builders? Nobody knows for sure-but we do know they were here.”

I do know that I have ancestors who lived in caves/holes in the ground. These are called the McClanahan Holes and they are located in Marion County which is next door to Baxter County.

The cliffs, the rock shelters and mounds those were their homes, that’s where they went at the end of the day, their shelter, where they raised their families and I’m sure some of them were proud of their homes. I wonder what they would think of our real estate today. What ever they might think I know one thing is for sure they would still love living here and being a part of the beautiful Ozarks!
